Calif. court throws out caddie lawsuit against PGA Tour

Guess in addition to my memory loss my reasoning abilities is also in a massive decline ......... the caddies are appealing the ruling.

 

“I think the judge was wrong in his ruling,” Harms (Kevin Harms, caddie for Kevin Na) said. “I talked to 20 or 30 lawyers before the ruling and not one ever told me we had a chance of losing. We are definitely going forward with the appeals process."

 

Clearly 20 or 30 lawyers cannot be wrong.

 

Apparently there are 168 Caddies listed as plaintiffs. Must have occurred to at least a few Pro's that essentially the caddies are suing them? Makes for a frosty relationship .........

 

The caddies aren't suing the pros.

All right I have explained this a few times in my previous post but let's try again.

 

The PGA Tour organizes a multitude of professional tournament on behalf of its members.

 

It's members are the professional golfers that qualify to be members of the PGA Tour annually.

 

The entity known as the PGA Tour is governed as described below:

 

PGA Tour members rely on the Player Advisory Council (PAC) and the PGA Tour Policy Board to represent them on issues involving Finchem and his staff. The PAC, a 16-player committee, serves as a filter to the policy board, which is comprised of four players and four volunteer independent directors, all of whom are among the nation's most prominent businessmen and one member from the PGA of America.

 

Finchem and his staff are the managers that run the PGA Tour on behalf of its members, the PGA professional golfer that qualify to play on the tour. Neither Finchem, his staff, the PAC or the Policy Board owns the PGA Tour. All of these guys merely manage on behalf of the PGA Tour members.

 

So the PGA Tour is essentially "owned" by its members who are the professional golfers that qualify to play on the tour for that year.

 

The caddies' are suing the PGA Tour. So ergo the caddies' are suing the PGA professionals members of the PGA Tour.

 

I specifically used the word "essentially" because I want to demark that while the caddie's are not naming each PGA Tour member individually by suing the PGA Tour they are suing the entity that every PGA Tour professional is a members of.

 

I am using the word "owner" in quotation because the PGA Tour is a not for profit enterprise and doesn't really have owner's but rather they have members and those members change every year.

 

Perhaps someone else can do a better job explaining this to Mr. MadGolfer76 as clearly I am failing.

The Tour settled with the caddies and the caddies dropped their lawsuit. Supposedly the caddies were getting $2,000 for wearing the bib and now they are getting over $6,000. If the Tour gives 200 caddies that stipend, that’s $1,2000,000 or over 5% of what the bib money is supposedly worth. Glad they worked this issue out.

As reported at the time, the 9th Circuit ruled against the caddies on their main issues on appeal, remanded on certain issues, but in essence, the lawsuit was on life support as of July 27. Whatever the reason it was worked out, and both sides obviously will say they are happy about it, there is nothing about the way it was worked out that gave the caddies any real victory in terms of the commercial issues that supposedly prompted the lawsuit. If they are pleased, that's what matters, but no "win" on the legal issues and guessing the settlement terms foreclose any possibility of this coming back up in the future.

 

To me it's a little comical that the settlement is being reported now, apparently because the caddies have publicized it - except for the posting of the decision on the 9th Circuit's website and the thread started here back in July, there was nothing being reported when the 9th Circuit finally ruled - media good about reporting stuff gets filed, pretty bad about calendaring and following up to see what actually happens, lol.

 

EDIT: lol, just read the article - I see "life support" is a popular way to describe their plight after the ruling in July (not August, Golf Digest).

Much ado about nothing, and if they are required to wear them, wear them inside out if they disagree. Stupid bibs are reversible. No one notices caddies anyway.

 

The bibs are worth a few million in advertising per tournament. I thought the caddies had a good case legally and morally. Too bad for them.

 

The caddies wouldn't be there without the pros. The pros say "wear the bib with Pepsi on it", it's their job. Plenty of good caddies waiting for the opportunity who would be glad to wear it.

 

Caddies can't go in the player's area? They're not players.

 

The Tour needs the caddies to wear the bibs or else they'd be losing $50 million a year. It's not a one-way street. Both of them need each other and they should share the wealth. In any other arena in life do you advertise for someone else an make absolutely nothing for it?

 

WTF? If I work for Home Depot and they tell me to wear the orange bib, I wear it.

 

Caddies work for the player not the Tour.
