Drinking water policy at a course. Not filling your bottle!

Nobody is saying we would sue but you better believe there are folks out there that would, in a heartbeat. And as shown above, you can find stupid judges and jurys anywhere.

I think the biggest complaint comes from courses saying no outside drinks or coolers and then not at least offering water on the course. It's just dumb. But yeah they can do what they want. We can talk with our money. You know what they say about money, it talks.

The McDonalds coffee case was nearly 20 years ago. Most frivolous lawsuits never get past an initial consultation with an attorney these days. And if they do, claims like these never make it past day one in civil court. I occasionally play golf with a District Court Judge (who hears civil cases), I can't wait to play with him again and give this scenario.

Ok, why does everyone seem to use the McDonald's case as a "bad lawsuit?" The lady suffered 2nd and 3rd degree burns from a cup of coffee. Her injuries required skin grafting. If I recall correctly, Mrs. Liebeck's labia was seared to her leg. Last I checked those aren't frivolous injuries... and a lawsuit was valid.

The issue you should have with the case is the AWARD she received. THE AWARD was what focused the world's attention on the need for tort reform and juries that are overly excited to give punitive damages. And, for the record, the case was settled for far less than the punitive damages when the case went to appeal largely because the plaintiff contributed to the negligence by her own actions of holding the cup between her thighs.

This is water. No question...golf course needs to provide unlimited water. Build it in to the price, but seriously...water...it's a given in my book.

I bring a 2 big bottles and some small frozen ones here in PHX, but when I run out, there better be water. I walk all year and in the summer I need about a gallon or so.

Did you ever hear about the case involving a burglar that sued a homeowner for falling into and getting stuck in their chimney while attempting to burglarize their house? Do you think that lawsuit was valid too?

When someone contributes to their own misfortunes, it's all frivolous. The McDonalds case is just one reason why attorneys are known to have such low morals and people question their ethics on a regular basis.

"Known to have such low morals????" Clearly you have a personal issue with lawyers. Maybe the ones you have dealt with fit your description. I got the impression from some of your posts that you are in law enforcement of some type. Should I say cops are known to have low morals based on anecdotal evidence of crooked cops? No, so don't try that with lawyers either.

Maybe you should educate yourself on the law before you start spouting your own made up legal theory. When someone contributes to their own misfortunes it is called "contributory negligence" and the award gets reduced by the percentage that a jury believes the plaintiff was responsible. The exact way contributory negligence is considered varies by state but one thing is certain it's not automatically "frivolous."

I hate getting in arguments on here and try and avoid it at all costs, but if you are going to insult me and the rest of my profession when your ignorance of the law is apparent, I cannot sit idly by.

I'm not saying they legally have to provide it, but by not providing it they are setting themselves up for a lawsuit.

Imagine a player goes out on a 90*+ day. Its not a busy day because of the heat and the cart girl is sent home because its slow. By the time this player reaches the 8th hole he has depleted his own water supply. He begins to feel light-headed, weak, and nauseated, all signs of heat exhaustion. He walks off the green feeling confused, and faints. There is no one around and he eventually starts seizing from the effects of heat stroke. Hopefully, someone will eventually find him before he dies.

If this person is found, and recovers, don't you think he would have a case against the course?

Im not sure where the presumption that he course has to babysit people and make sure they stay hydrated enough comes from. I think we are all responsible for our own well being.

Now, if the course didnt allow you to bring your own water, or didnt allow you to leave the hole you were on to get back to the clubhouse, or locked you inside the gates until you finished your round...fine. But its absolutely the responsibility of each of us to make sure that we adequately hydrate ourselves on hot days.

This is like suing burger king for making you fat. Sure, you can do it, but youre not gonna win.

[color=#800080]it is called common sense. Courses that do nots provide water are stupid. I haves played a lot that give outs free bottles. Two in cup holders ands four in the little coolers on cart. I suffer from hypoglycemia ands if i forget sugar things , i will nots play if the course does nots have soda available.[/color]
